Oklahoma Divorce and Separation

Oklahoma has one of the highest divorce rates in the United States. The Centers for Disease Control and Prevention (CDC) reports that, as of 2011, Oklahoma’s divorce rate was higher than any other state in the nation. Despite the Oklahoma Marriage Initiative and other measures to try to reduce the divorce rate in the state, the number continues to rise. According to census reports for the year 2000, 11.6 percent of people over the age of 15 living in Oklahoma in 2010 were currently divorced. By 2012, the number had climbed to 13.5 percent.

The high divorce rate in Oklahoma has prompted legislators to propose bills making it more difficult to obtain a divorce. One would strike “incompatibility” from grounds for divorce. Another would increase the waiting period between filing for divorce and a decree of divorce. The legislators who proposed these bills say it is “too easy” to get a divorce in Oklahoma.

Guardianship

If a minor or adult is in need of care or supervision that is not otherwise being provided, a court may appoint a guardian to oversee the well-being of the ward. There is a statutory order of preference in appointing guardianship, but when there is imminent risk of danger or financial exploitation, the court may appoint a Special Guardian or Emergency Guardian.

Becoming a legal guardian brings with it weighty responsibilities. If a guardian fails to uphold those responsibilities or has interests that are not in the best interest of the ward, guardianship may be revoked.
